I have recently claimed for HRMC.If I've to receive a visit from a doctor,do I have the right to ask to read his report before he leaves,in particular,the distance he says that I can walk?If so and I disagree with something he has written,do I have the right to challenge it before he leaves my house?The reason I ask this is the stories I have read of the "rubbish" that some doctors write on their report.

Unfortunately you are not permitted to read the EMP's report during a home visit.

There was formerly a procedure where a claimant signed a statement of what he/she had said about their medical condition, but the statement was completely separate from the actual doctor's report. This procedure is now defunct as in reality, it served no useful purpose.

You would only have access to the EMP's report, whether favourable or adverse, once a decision had been made on your DLA claim.

Hence the reason of having someone in the room with you who can take notes of what transpires during the assessment.

Picasso, The doctors do tend to ignore the new GMC guidelines which they should adhere to, when it comes to statements. However if or when you do realise the report is incorrect you can have your objection noted on the records..from guidance issued to DWP staff in relation to handling subject access requests and which you may find helpful.
285 Some customers dispute medical opinions provided by either their or the Department’s doctor. DWP cannot change or delete this information and the customer should be advised that only the doctor who gave the opinion can do so. We are still required to make it clear on our records that the customer does not agree with this information/opinion.
