Good afternoon,
I’ve had a search through but can’t see this exact question. Apologies if I’ve missed it.

My question is: could my adult (34yrs old) disabled son be entitled to Severe Disability Premium - he lives in Residential Care with 4 other adults?
He’s in receipt of higher rates for both PIP components and Income related ESA. He doesn’t actually get the daily living comp of PIP as Residential.

Due to migrate to UC this next month, so I want to investigate this on his behalf first. I am his DWP appointee.

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum.

The severe disability premium (SDP{) can be awarded in addition to any other premium that may be payable. It is £82.90 a week for each person who qualifies. To qualify:

~ You must receive a ‘qualifying disability benefit’.

~ no one gets a ‘qualifying carer benefit’ for looking after you. These are:
~ Carer’s allowance;
~ carer support payment; or
~ the Universal credit carer amount; and

~ you technically count as living alone

If you both get a qualifying disability benefit and no one gets a qualifying carer benefit for looking after either you or your partner, your SDP will be £165.80.

Asa your son is not in receipt of a qualifying benefit (PIP daily living component) the he would not be eligible to claim SDP.

As your son is in receipt of IR-ESA then he will soon receive his migration letter to apply for UC, he will be better off claiming UC as he does not receive SDP.

You need to seek specialist advice from your local Welfare Rights Organisation: advicelocal.uk where they can take all your son's circumstances into consideration when giving you advice.
