Migration ESA to UC was created by wimb24
I have read through the 57 page guide and viewed the migration form.
If a person has discounted savings, due to a DWP backpayment that was their fault, where can this be written on the migration form? I cannot see a free text box
Thank you

Hi wimb,
I don't believe it is. I believe you inform them when you received it and you are given 12 months before it is classified as savings and taken into consideration. This happened to me, and I wasn't aware of the 12 months rule, and as such, for a while, my UC was reduced, due to the savings amount being over £6,000.

Thank you for your reply. We have a letter saying "the capital will be disregarded from the date they are received for the remainder of the award to the income related benefit". I hope that the migration from ESA to UC will uphold this since UC is an income related benefit. There is nowhere on the form to upload a letter, do you know if the letter can be uploaded to the UC journal so that it can be viewed by whoever assesses the migration award?

Hi wimb,
It can be. You send a message in your journal asking for someone to provide you with a link to upload additional information. This link will accept up to 10 attachments of various format.

Thank you for your reply. I also remember a paragraph to put in the journal regarding the automatic transfer from ESA support group to the LCWRA group. Would it be possible to paste that paragraph here, I am not sure where I saw it. Thank you.

I think it is a paragraph to put in the journal which incorporates Regulation 19, so that the claimant receives the health related component of UC from the first payment.
Regulation 19 provides that a claimant may be treated as having limited capability for work, or limited capability for work and work-related activity, for the purposes of an award of universal credit, if they were previously entitled to the work-related activity component, or the support component, of old style ESA.
