Hello again,
I have received MR notice, 8th May, date on notice is the 2nd, which I thought was a rather quick reply! As it was on only the 28th of April that I had requested it, anyway, the envelope contained three letters, 2 copies of each, letter 1) ESA Entitlement Decision… letter 2) ESA Overpayment Recoverability Decision…and letter 3) ESA Civil Penalty decision! Letters 1&2… goes like this ‘We have taken into account all the information available…we have changed our decision and you will be sent a separate letter with details of your revised award..’ not got a clue what this means… letter 3 they haven’t changed their decision! Which I’m not very happy about!
They have also got the timeframe wrong of how long I have been in receipt of ESA they said I started to receive it in August 2017, which is way wrong as I distinctly remember appealing against a decision that was made about my claim way before 2017! Which I won and ESA was backdated!
Any help/advice/guidance or feedback would be most welcomed. Thank you for your time.

I can't tell you anything else until you receive the letter and see what it says. It sounds positive, and it looks like you have won your MR. As only 27% are successful, that is fantastic.

Good evening,
Further update to overpayment fiasco, MR notices received on 2nd May, 2 decisions changed Permitted Work Entitlement Decision changed, Overpayment Recoverability amount changed, Civil Penalty notice NOT changed, although their excuse has changed for this!! Along the lines of ‘we know that you are not dishonest, we believe that you did not manage your claim very well etc…!’
It just feels a bit of a mess, as part of the information that the notices contained is incorrect. I have now received an email from local authority saying that they are reviewing my HB/Council Tax reduction due to this ‘overpayment’. I am still in receipt of ESA so I don’t know how this will go. I have been in touch with advice.scot who are now in the process of lodging my appeal as there were mitigating circumstances that were beyond my control at the time and it is imperative and very important to me, to have this black mark removed from my name!
Any further help or feedback that you can provide would be very much appreciated it.
