ESA success, getting documents from DWP was created by canttrusthesystem
Hi,
Having recently done an ESA WCA after a 5-year gap, and having used your very informative Guides to help, I just got the DWP response today (I submitted it for 12th October deadline, so they were quite quick) and I'm pleased to let you know that they're continuing my ESA, and keeping me in the Support Group. The letter goes on to say, in a paragraph headed 'Future Work Capability Assessments': 'We won't ask you to go for another assessment unless there is a change in your health condition.' Do you know if this means they have applied their 'exemption' from reassessment rule? Is there anything I may need to know about this - other than to tell them if things should improve (very unlikely, unfortunately)?
I would now like to apply to the DWP for all their paperwork relating to this decision (I've done this previously but have forgotten how) - I have searched on here but cannot seem to find the correct information - I think it used to be in a FAQs section on the main menu(?) - I've checked the Forum FAQs section but can't see it there. Hope I#m not overlooking it.
With thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Congratulations on the award, well done.
Yes, this is the phraseology that exempts you from further assessment. There's nothing additional that you now need to do.
You can ask for the assessment report, it's an ESA85A if you did not have a face to face or you can make a Subject Access Request for all the documents used in the Decision, the former should be sufficient to understand how the Decision was made but the latter will be more complete.

Hi Gordon
Thanks very much. I don't think I would be in this position without the Guides from this site. I honestly think they provide the best and most accessible information available (and I did 'look around' before joining this site, some years ago, and was involved in welfare rights work myself, but many moons ago, now), very well complemented by this forum.
Yes, I remember now - it was called a SAR. I'll look that up and go and do it. Thanks.
I'd just like to say that I think that the work that you personally and consistently do, and have done for years on this forum for us who have to claim benefits is amazing Gordon. Thank you very much.
Best regards,
ctts
