PIP MR success! However, not backdated? was created by Melanie Tudor
Hi,
Thanks to all your wonderful advice and this site, my MR was successful and I have now been awarded mobility at the standard rate after losing it after the transition from DLA to PIP.
What concerns me however, is that they do not backdate payments. Can I make a claim under the following circumstances - I initially submitted my MR in February this year which was received by DWP, however it was filed and no action taken. My support worker phoned two months ago and was told that I would get a phone call from DWP. After 3 weeks, I spoke to them on the phone and that was the first time they said they would proceed with an MR and they apologised for the fact that it had been filed without any action back in February and they said that for some reason whoever entered it into the computer didn't realise it was an MR! (even though it clearly said MANDATORY RECONSIDERATION REQUEST all over it!!).
I am so happy with the new decision to award me mobility but surely it is not my fault that it has taken half a year? If they had actioned my MR in February, then I would have had that money for the 5 months my file was just sitting about in a filing system somewhere. Do I have a claim for them backdating it and if so, how do I proceed? I advise everyone who submits an MR to keep chasing it because otherwise you lose the money even if the decision at a later date is changed in your favour.
Many thanks

Based on the information you have posted.
As your MR was in regard the original Decision on your PIP claim it should be backdated to the date when that Decision was effective from, which should have been the day after your DLA ceased payment, I am guessing from your post that this should be February of this year.
As a result you should be entitled to back payment of the additional award from then.
