I am sorry to hear of your problems !!

Appealing to the Upper Tier (if possible) would not have any bearing whatsoever on which benefit you could claim, and would certainly not mean that you : "would be put on job seekers allowance,"
It is true, that if you appealed to the UT alone, you would not receive any benefit whilst doing so.
However appealing to The UT, and making a fresh claim for ESA or JSA are two totally separate issues.
If you can obtain a fresh fit note (Med 3) from your G.P., and six months or more have passed since the date of the original adverse decision that you appealed, you should be able to make a fresh claim for ESA using the ESA 1 Claim Form and the accompanying fresh fit note.
