by sending me the ESA3 form do I have to return it if I feel that I don't fit the criteria for claiming?
sorry for sounding a bit slow but it really confuses me!
Hi J,
Crossed post, see :

The DWP do ask CB ESA recipients to fill in ESA3's to see whether they are in receipt of an Occupational Pension themselves, as this income can affect CB ESA.

I didn't send the ESA3 form back, I have been worrying about it all week as the conformation call re successful migration was on 7th. Nov and to be honest there hasn't been any change in my circumstances that required re assessment, i think it was a belt and braces reaction from the adviser that rang. It seems illogical that on the same day that I am awarded the transfer they need a re assessment of my application.
what I have understood more clearly from following the discussions is that ESA is essentially one benefit with different ways to access it - contribution based or income related.
Thank you all for your help it really has been much appreciated

Hi J,
Just to reiterate, the ESA 3 is not to reassess you with respect to whether you qualify for ESA under the work capability assessment, and which group you are placed into. The ESA50 is used for that purpose.
It is to capture your current financial situation.
Hopefully, there will be no adverse effect caused by you not returning it, but you may well receive a reminder querying why you have not filled it in and returned it.
