Order of events
1.was in support group after appeal and awarded contributory ESA
following medical transferred to WRAG
2.after one year contributory ESA withdrawn due to 365 day time limit so was receiving conts only
3.unable to qualify for income based ESA
asked for super session as condition worsened
refused reinstatement to support group
4.appealed against this and on 13 september won appeal to be reinstated to support group from april 2013 not to be assessed again for 24 months
5.yesterday got letter from DWP containing ESA1 which is the application form for ESA together with ESA 318 said that I may now be eligible for ESA and to fill in the application and send it back.
6.Rang them to ask why I had to re apply for ESA when the tribunal had overturned the original decision and awarded support component. I was told it might be because I was in the WRAG for some time and to send it in with covering letter to change of circumstances team. I am now worried that the whole nightmare with ESA50 and medical will start again.
Any one come across this scenario?

When your payments were stopped due to the time limiting of ESA(CB) your ESA would have been closed on the DWP computer system, if the time between the closure and your ESA(CB) being re-instated is not too long they can resurrect your original claim (I am not sure how quickly the claim is deleted), but if it is then they need to build it from scratch which is why an ESA1 has been issued.

I would suggest you include a covering letter explaining that the form is in connection with your ESA(CB) being re-instated as you have been placed in the Support Group.
