Hi Ive used the members guides to good affect and I followed the ESA appeal guide and requested a copy of all of the evidence / notes / phone calls / etc in a letter I sent by recorded delivery. In the guide it said they have 40 days to supply the information - What I need to know is what do I do if the information is not provided to me in the 40 days ?? I have evidence when they received my request and Ive counted 40 working days from then and their time is up tomorrow !! Any help I would be very grateful thanks Ray.

You could send a reminder letter with the threat of a complaint to The ICO, or you could make a complaint to The ICO in the first instance. :
