I am going for descriptors as well. Hopefully, it won't get to relying on the clause but if it does:-

Just to check, so if I can meet the Exceptional Circumstances reg it is up to them to proove that the substantial risk is reduced sufficiently by the medication?

Hi R,

Yes and no,

If the DM was to apply the new amendment regarding prescribed medication reducing the "Substantial Risk", you could ask for an explanation and challenge it.

However, the burden of proof is on you to show that there would still be a "Substantial Risk" even whilst taking any prescribed medication.

The key phrase is that the medication must have been prescribed, If it has not, then it cannot be considered. It is also worth noting the Decision Maker is not medically trained so they are not really in a position to consider the benefit of one treatment versus another.

I have gathered the supporting info, really good detailed letters from GP and Consultant, and am now starting on the form. A couple of questions.

If I use the PDF version and print it out to send rather than the handwritten one, will they use this too make assumptions about my abilities? Is it better to do the handwritten one?

I have provided very detailed reports from my GP and Consultant. I want them to make the decision without a FtoF if possible. Would it be ok to say how ill the FtoF would make me (Severe anxiety and depression) and give them a copy of the Report from my last FtoF which was in 2010 for IB? This clearly states how I was then and the other evidence shows I have not changed. I realise they may still want to see me just wondered if it was ok to do this.
