Big thank you to B&W for the valuable information. Just assisted my friend to an ESA tribunal which took 14 months to be heard and my friend went from scoring 0 points at ATOS medical to being scored18 at tribunal. The GP and the judge were very nice and listened to us. Friend has been plaed in ESA wrag group which he is happy about as he is slowly recovering.
Thanks again.
Thanks again.

Hi accompanied relative to ESA tribunal. Tribunal was successful and he was told he would be placed in the WRAG group. Also told that he no longer had to submit fit notes however this week he was not paid his benefit. On visiting the local office he was told decisions take 6 to 8 weeks to process and he still needs to submit a sick note. I don't think the DWP realise how stressful this process is for people whom are not well and have to cope with disabilities.

I agree Karen, the system is very difficult to negotiate unless one is very well versed in it! We usually warn members that they should continue submitting sick-notes until notified by DWP that they have received and actioned the Tribunal decision.

Hi K,
I am sorry to hear this, as MHB states it may be necessary to continue to provide fit notes to the DWP until they have updated their files to reflect the tribunal's decision.
If your friend explains what has happened to their G.P., there should not be a problem with the G.P. back dating a fit note to the end date of the last one issued.
It may help to include a copy of the tribunal's decision notice with the fit note.
