Just on lady solicitor on the panel. She said she could not make head nor tail of what the appeal was for. She said the appeal appeared to be for ESA( income related) I told her I have never applied for this as I am not entitled to it as Husband works.
I explained that this appeal was to be placed into the support group after looking back through the paper work she said she would be happy to rule in my favour to be placed into the support group how every she need to sort out what was going on, what she was reading out from the DWP was completely alien to me,
After seeing how unset and distressed I was becoming she said there was no point continuing and she would sort it out and send me a letter with her decision which I will receive tomorrow or Monday.
I have no idea what I can do now.

The first thing is to see what happens with the Decision which I am afraid means waiting until next week.
Just to confirm, there was only one person on the panel? This being the case.
If it is in your favour then obviously you should have nothing to worry about.
If it is not a Support Group award, then I think you have good case to request a Set Aside due to the Tribunal panel not being properly convened, but you will need the assistance of an advisor with experience of appealing First Tier Tribunal Decisions.

I was so emotional I just cried, It has been an absolute nightmare and has taken 11 months of worry and heart ache.
I joined your web site because I had no idea about how the benefit changes were going to be so difficult to understand. It has l been a massive help.
I will be renewing my membership again this year. My next challenge will be the change over from DLA to PIP, and I am sure I will be invited to an ATOS medical fairly soon to see if they can take me back out of the support group.
