Hi Mods

Quick update, last atos WCA cancelled in June as i said, new date arranged for July, low and behold, this was also cancelled this time 24 hours before the interview, complained to DWP about Atos farce,
Atos then sent me a letter asking for more info, duly sent in July and as of today no reply to my questions.
contacted DWP for an update, told they had lost my ESA form, sent another out to complete, which we did.
Still heard nothing, so phoned again, told it was with Atos, so phoned Atos, was told the person who i needed would call back the next day, never did though, a few days later rung them again, asked for an update, they said the would look into it and call me back, which they did and now have a WCA in a few weeks time.
So to sum up, now into the 10th Month with no money, 3 ESA50/13 books filled in, 1 lost, but now said they found it (doubt it though) and 3 WCA arranged and they cancelled 2 of them, so i guess we live in hope the next WCA will happen. But will they take my condition as it was 10 Months ago, or how my condition is as of the date of the WCA??

It will likely be the time of the WCA as the LiMa software that controls the interview assumes that everything is relevant to that day.

Hi mods

Quick update, had my WCA, however we arrived on time, after a 30 min wait, enquired as to how much longer we have to wait, was told the Dr was still writing the report from the last interview, we were in total made to wait 55mins,we reckon the previous guy must have left his WCA at least 40 mins before so the bulk of his report was made when he was not present.

So we finally went in, it was not a Dr, but a nurse!!!!! never mind, i was asked questions about my cancer, i didnt know i had cancer, turns out my other half spotted that various papers had someone elses NI wrote on them, (these quickly removed), have you got all my notes from the DWP i asked, yes she said, when i asked if she had various latest papers, she said no, good job we took copies with us.
She also referred back to my previous information from my previous WCA ( 2 years ago) which was by the way full of untruths. after about 30 mins, was told you can go now as it will take me another 30 mins to complete the forms. Surely this cannot be right, how can they fill in the answers if i was not there, is this an error of law, maladministration.

the DWP could not make a decision from January to August as they said it was old information, yet we send latest info, they chose not to send it to Atos, then Atos refer back to a WCA info which was 2 years ago,.

Is there anyone i can take this up with before i get the results, and would i be able to claim any benefit as i have now been waiting 10 Months for a supersession.

I am afraid that it standard for the WCA report to be completed after the interview, the HCP enters information into the LiMa software as the interview progresses, but it is only printed out after the session is completed, they then need to validate the content and make any hand written comments that need to add.

It is unusual for the HCP to refer to a previous report but as this is a Supersession and you are claiming a deterioration in your health since the last Decision, then it is reasonable for them to refer to it as they have to be able to distinguish between how you were then and how you are now.

In terms of other benefits, you could make a claim for PIP if you have care and mobility needs, but this will take as least as long, and probably a lot longer, than a Decision on your ESA.

You can, in principle, claim JSA, but you cannot claim ESA and JSA at the same time and declaring yourself fit for the purposes of JSA will limit any award for the Support Group that may be made.

Hi to all of the mods.

Just a quick update, got the brown DWP letter today 21/10 after been 10 Months with no money.
Had a face to face WCA 10 days ago, now i have been placed in the support group for 2 years after phoning the DWP as the letter only put me in the SG from October 2013 to November 2013!!!!
Spoke to a nice gentleman at the DWP who was very helpful, told me to ignore the dates on the letter, as i had been placed in the SG for 2 years.

Thanks to you all, both the mods and members for all you help and advice, as without it, i would not have known which way to deal with it. will keep dropping in and having a sniff around the site from time to time as it was well worth the subscription.

That is really good news !!! :cheer: and a fitting end to this unfortunate saga.

Yes, the November date on the decision notice is purely for administration purposes.

As you have a 2 year prognosis from October 2013, you should expect to receive a new ESA50 for reassessment circa August 2015.
