IB to ESA

I have been on long term IB,prior to April 2001,and have received the ESA 50 form.
My illnesses are chronic and progressive and feel I woulld qualify for ESA on health grounds.
I have an occupational pension, capital in excess of £16k and my wife is working so feel I would not qualify under means testing
Should I complete the forms or will I be making a false claim?

Hi TR,
As you are currently in receipt of IB, which is a contributary based benefit, if you are found to qualify for ESA in The WRAG, or SG, you would be transferred over to Contribution Based ESA, see :
What will I be transferred to?
See also :
Will my pension be disregarded under ESA?
You may also wish to read :
IB, IS, SDA, Migration to ESA FAQ’s
Therefore, there is nothing to stop you filling in The ESA50.
You may wish to consider using the PDF Version, many members have and find it is much easier, it can be downloaded from the link on this page :
Using The PDF Version Of The ESA50 Questionnaire
Pertaining to this, see :
How long do I have to complete the ESA50?
ESA50 too big for the envelope
Sending Documents to the DWP or ATOS
You could then fill this in, whilst referring to the corresponding section of our ESA Claims Guides, which are the 3rd and 4th links down this page :
ESA Guides
You should take a look at all of our : ESA FAQ’s also, as I am sure you will find them helpful.
Please return to this thread if you have any further questions.

As you are receiving IB which is a Contribution Based benefit, you will be transferred to ESA(CB), which is not effected by the amount of capital you have. If your pension is currently disregarded under IB, then it should continue to be under ESA(CB), otherwise the rules are the same as IB.Can you offer me some advice?

You need to be aware that ESA(CB) is limited to 365 days for members of the WRAG but not the Support Group, see
12 Month Limit for ESA(CB)
If in doubt seek face to face advice, see
Where to get advice?
or Google "welfare advice" with your town or county
