It must be my human right to be examined by a doctor who is a specialist on my medical problems. May be we should get a class action against Atos.

As the law currently stands there is no requirment for an Examinig Medical Practitioner to be a specialist in any particular area of medicine. As long as he/she is a trained/qualified and registered medical practitioner he/she is judged as competent to examine/assess claims for Social Security Benefits.

It does not stop you obtaining reports from specialists to submit to the DWP to help substantiate your claim to benefit.

Pete is right. However, there is nothing to prevent you from providing medical evidence from any doctor treating you now, or in the past who {b} IS [/b] a specialist in your condition.

You can obtain these by 'phoning your Consultants secretary and asking for any copy letters, or if they don't agree, you have a right under the Data Protection Act 1998 to view your hospital case notes and ask for copies of any relevant medical reports.

If you wish to do the latter, contact the Patient Records Manager ( or similar) title to arrange to view your case notes.
