Hello there hope all is well !

Basically my friend had a renewal form for their DLA.

They have completed the form (its the short version) and just ticked that everything was the same and mentioned in the anything changed section that on top of everything else have had a breakdown so are receiving help with their mental health.

Its come back with the care component remaining at high but have reduced mobility to lower rate !

They initially received higher rate mobilty due to having
chronic asthma and being virtually unable to walk the exertion causes attacks and pain etc
My friend is still under the care of consultants and still is virtually unable to walk

Having read your forums and advice I can see they should have repeated everything and treated the renewal form as if it were a fresh claim as far as evidence etc goes.
The damage so to speak has been done though they have rung up and asked to appeal the decision and a form has been received.

I know this has been longwinded but basically I just want to know is it worth their while in the other information box adding that they didn't understand the form/were a bit misled by the tick box and assumed that it was understood to refer to all the evidence submitted on their original claim when ticking my needs are the same and then going on to list all the reasons etc why they should still get higher rate ... OR ... should they just say we have given all the evidence etc so can we go to oral hearing ?
thing is if they haven't given all the evidence again in the renewal form will they just say at the appeal the only evidence is the renewal form and that don't say a lot ??

thing is if they haven't given all the evidence again in the renewal form will they just say at the appeal the only evidence is the renewal form and that don't say a lot ??

by "they" I mean the tribunal board

Hiya

I had a problem when I completed the short form too. I was given nothing. I went from high mobility and middle care to zero because of the wording of the small form, it's worded it as if they are going to compare it to the first form you filled in with all your information on.

However, I rang DWP up and spoke to a lovely lady, and went through everthing on the letter that they said I could do, and explained why I could not. I must have spent 45 mins on the phone. I asked for an appeal, and they said ok, but the claim would be looked at again first, with this new information.

I also wrote to my MP about the form, as I do not feel it's fair.(I have never written to an MP before, but I was angry about this small form)

After three weeks I got my DLA back on a re-consideration. It was the same as before, high mobility, middle care, indefinate now.

Ring them up my friend, just go through your letter with them and make a point of keeping a record of the conversation. Not just what is said, but the time, date and name of the person you speak to, which they give automatically.

The moderator's have information about this form and advise anyone to ignore it, and send for the big form DLA 1

no need toend for it, if you get little form just download big form and ue that one

download save to dek top and fill in slowly saving as you go along :)

no you have to print it off but save it to usb stick and the local libary or a print shop can do that for you with extra copy for your records
