Hi All, Just thought I would seek out your advise. Just this minute I received the dreaded call to say I was not entitled to ESA and it ceased on the 20th March . I have been advised to 1/ Claim JSA or Income Support 2/ Appeal. I thought that income support was being phased out!! I have Menieres and I know with the way it affects me I would not employ me to work!! What to do ???

Some groups can claim ESA, but it isn't usually a benefit for people appealing against an ESA decision. If you choose to appeal ESA, then you can claim ESA at assessment rate whilst you appeal (but not following a failed appeal even if you appeal further to the Upper Tribunal). If you wish to claim IS, you should seek face-to-face advice as "ifs and buts" run to several pages.

Thankyou Survivor, I have since been in touch with CAB and am going to appeal. I also called back Job Centre Plus to ask if i still get my SDA paid.(awarded because I get dla care middle rate and mobility low rate). But they said it was linked to ESA so it would stop also until it is reinstated pending appeal! Honestly just as you think there is a light at the end of the tunnel they go and mess it all up again!!

A friend has been turned down for the support group of esa even though he is very very ill. He asked me if this would affect his dla. Can any1 help him ? Thanks

Belmont,
Information from ESA WCA can be used to review your DLA award.
However this will not necessarily happen, the only way they could use your ESA medical information to review DLA, is if there is conflicting information, ie, could be re walking distance etc.
You need to request a copy of the WCA Med report, to see how many points he got, and what for, you would need this any way if they were to try and alter the DLA.
Also has he been put in the WRAG, and what is his expected review date (Prognosis).
If he feels he should be in the support group he needs to appeal asap as there is time limits using form GL24 which he can request.
There are exelents guides on here about appealing ESA DLA decisions.
Further Steve Donnison is currently compiling a new guide for the new ESA WCA that is to be used at the end of the month.
