new ESA50 questionnaire received after 4 months was created by Alberto Ballsup
Hi, all. This is my first post here so I hope I'm doing it in the right way/ place/ etc.
Can anyone please tell me; is it normal that I've been sent a new Limited Capability For Work Questionnaire after only 4 months or so of being in the Work Related group and receiving ESA? I went for a medical on Dec 7th 2010. The letter with this new ESA50 says I may have to go for another medical once I've sent the form back. The last one was an ordeal I'd hoped I wouldn't need to go through again soon - my condition(s) have only got worse, not better.
I'm currently in dispute with my council over Housing & Council Tax Benefit. So far I've received neither and I'm really struggling. They'd been investigating my claim the last 3 months, found nothing untoward even having had me under surveillance for a time ( I DO live alone since my ex walked out - unless you count the cat), but still they continue to drag their heels (out of bloody mindedness, I guess) - so last week I wrote insisting they give me a decision in writing. No reply so far, but then this new ESA50 arrives in the post just days later. Is it just coincidence? Ever since I found out they'd been watching my home and following me, etc, I've been so paranoid I feel the council's behind everything that happens to me! It probably sounds daft but I'm actually on antipsychotics now (added to everything else), as a direct result of their actions.
Sorry, I digress. Has anyone any words of comfort/advice/or what-have-you?
Many thanks. M

I am afraid that whilst four months is short, it is not unusual for the DWP to re-assess at this frequency.
If you disability is permament or one that gets worse over time, you could try and get the re-assessment deferred, otherwise you will need to complete the forms, in order to continue to receive benefits.
Have you received the old or new ESA50? The new one is dated 03/11, as the tests on the new form are different.

Hi, Gordon
Well, that puts my mind at rest - at least I'm not being singled out! Cheers for that.
The form is dated 3/11 so it's the new one.

Good grief, what on earth are they following you for? This paranoia by LA's is getting a tad out of hand imo.

Please try not to worry about them watching you etc, i have been in a similar situation re council tax they turned up twice without warning to ask if i still lived alone, it sometimes feels like we are living in a goldfish bowl. Re HB and CT are you on contribution based ESA or income related? The reason i ask is i was put onto the wrong one, they had put me on contribution and it should have been income based and once i had been changed to income based i got HB and CT without any problems.
I really hope you get this sorted out quickly. Have you been to CAB or taken any advice on this? Please don't try and deal with this alone, there are organisations out there to help in situations like this. Please let us know how you get on with this!!!
Good luck and look after yourself. Big hugs!!
Mm xx
