2 people same claim 2 decisions

2 people same claim 2 decisions was created by scrupples
my partner and her best best friend both have remit and relapse ms, both diagnosed and see their gp`s and consultants regularly. It affects them both the same, same symptoms, same side effects from meds, same everything. We made a claim for both using the forms in the members section, and put the same on each form, (the misses also has severe migraine weekly lasting a couple of days at a time, so this was also explained in detail on hers) and sent them off a week apart. Last week her friend got awarded high rate care and mobility indefinitely. Today our lasses has come and she has been awarded NOTHING! how can this be?

Whats the best thing to do now?

two people same problem does not mean same affects people manage things different also the reports from gps pould be different and test results if asked for would be different too

You can ask for a Reconsideration or you can appeal, which will include a Reconsideration.

I don't know whether you used our Guides in preparing the claim, if you did not. it would be worth having a look to see whether you would have answered the questions differently.

You should certainly, whichever route you choose, have a look at our Appealing a DLA Decision guide, as this will better explain your options and the processes involved.

Consider getting face to face advise from your local CAB or Welfare Rights office. as they will have experience of these situations and will of course be able to look at all aspects of the claim.

both decisions were back 4 weeks after sending them, and our lass was at the docs yesterday and mentioned she had made a claim and asked if the DWP had been in touch and they had not, also the same for the consultant that she saw last week. So its not based on them also the forms were basically word for word, other than our lasses that also explains about her migraines so shes actually worse than her friend.

That sounds desperatley unjust. You must feel very let down by the decision making process. You must appeal and get consultants etc to provide additional info whether they ask for it or not.

Sorry you've got to go through the hassle of appeal. Good luck with it.
