hi all" was recieving esa( wrag) since late 09 asked to atend another assesment dec 2010 6 points. so failded i would like to know do thay no you are reciving esa from your records otas hold or is it classed as a new claim for esa every time you fill out the pink form . also the lady at the assesments asked completly different questions if its surpost to be computerized how can that be?my bet is its potluck who you get on the day .thanks marina.
If you have successfully passed the ESA medical and been found unfit to work, the subsequent ESA50s are classed as re-assessments of you existing claim.
If you fail the test and re-apply (after six months), or apply because of a deteriorated condition then this would be classed as a new claim.
You don't say whether you have appealed the decision, if not, you only have four weeks from the decision to do so, although you may be able to argue the case for any extension, because of Christmas and New Year.
