Can anyone advise please, from info I have read SDP is payable if you get HRC / MRC but I have read it depends on who you lie with but it does not give 100% of the conditions and says there could be circumstances when you can still get it depending on who you work with.

Anyone out there that gets this benefit or been refused this benefit may be able to help me with the answer.

Man lives with wife and 2 sons, 1 gets child benefit and in education, other is 18 unemployed claiming JSA and in part time education.

Any ideas from experience would be appreciated from others.

To get SDP there must be no one 18 or over living with you as part of your household (as opposed, say, to a lodger) who is not on DLA, and there must be no one claiming CA for looking after you.

Therefore as this man has an 18 year old living as part of his household, then unless the son is on DLA, he will not be able to get SDP.

I receive the Severe Disability Premium as i am on HRM/MRC and live alone, it was paid automatically when i started receiving ESA (Income Based).
