hi,i am new to forum, i have just had my income support stopped and my DLA stopped.i was investigated last year and recieved a letter from DWP new years eve this year.what a year i have had,here is what happened, the DWP went into my bank account and got the last two years statements and noticed payments going into my account every month, this is what they said was undeclared income.but when i was at the interview under caution i explained to them that the money that was going into my bank was the money that they was paying me in my post office account, all i was doing was taking my money out of my post office every month and put it into my bank to pay for direct debits.i appealed this dicision but got nowhere, they think that because i bread my dogs i am making a living, but i do not, i just make enough to feed them and all the worming and vet fee's ect.but when studying my bank statements i noticed that i had 2 cheque's paid into my bank one for £3150 and one for £1350,so i researched these cheque's and got proof of where they came from, one from the building society and one from the insurers for earthquake damage, also 3 cash deposits, £2700,£2000 and £1000, the first two cash deposits was money lent from my mother which i pay her so much a month and i get reciepts,the £1000 which me and my wife saved up and put it into the bank, i have got to go to a tribuneral, don't know when but they want just under £4000 back off me, i have tried to get a welfare & benefits solicitor to fight my case, but no joy. the goverment does not fund this proses any more,we know why, because they do not want us to lose our cases. this has caused me to get bells paulsi, and now i have allapeasha, and doc's put me on prozac, aswell as all this i have a son on the blind register and a wife that is clinicly depressed.my DLA is another story.can some one help.

I note that you say that the DWP accessed your bank details for two years and you were subject to an interview under caution.

Are the DWP continuing to pursue suspected fraud action against you?

The investigation is finished. I have just got to see what the outcome of the tribunal is? I have nothing to hide but I would rather have someone with me who knows what they are doing, or they will probably rip me to pieces.

Regrettably if you cannot find a representative you will end up having to speak for yourself at the hearing. However....

You mention having appealed but got nowehere ibn relation to the income which you explain here relates to dogs

I dont know when that was , whether you have a case for appealing the decision or not so for present purporses I am assuming that is 'history' but the DWP may try and influence the new tribunal with adverse findings from that previous appeal

You will need your mother (preferably there) to say you borrowed money from her, and so on and on. You need to explain yourself and where possible back it up with evidence

The fact that you are not being prosecuted after an interview under caution is at least a relief but I do not know the reasons why . In cases below a certain level, or where a claimants mental health would be badly affected they do not prosecute. I am offering a very rough explanation late at night and I'm tired However, others here may have alternative suggestions but there is the Community Legal Service that some other members of B and W know theb contact details for, and they may have advice locations you have not thought of or know about I don't know

To give accurate and reliable advice about a specific benefits problem, we'd need to know a great deal about your income, savings, health, household arrangements and more. To give advice without all this information would seriously risk misinforming you.

You certainly need face-to-face advice and possibly representation at your forthcoming appeal tribunal.

Am I missing something here?.
I am under the impression that DLA is not a means tested benefit-am I correct?.-but income support is?.
