Hi All
Will my wife get a ESA50 if i claim all our Benefits ,We both get DLA ,She gets AA ,This is as well as IS for both of us ,I am getting mixed messages from people ,some say Yay ,some say nay. About 18 months ago i was sent a ESA50 ,which i filled in and sent back and got a letter then saying that i would not be bothered again until 2013 .
This is all quite confusing to us both and though i have looked i cant seem to find a diffinitive answer to the questions i have ,Why was i not asked to attend a medical if every one else seems to be going .Is this unusual ?Why wait till 2013 and will it be a repeat of last time weeks of worry and then being told its alright but dont bother .
Will my wife receive a ESA50 ? Or is She excempt because i claim for her ?Answers or a clue as to where to find them would be gratefully received.

If you are claiming for your wife as a dependent on your ESA claim, she will not receive an ESA50 as it is you as the claimant who is claiming as sick/disabled.
The application of the ESA work-capability assessment can be undertaken in some circumstances without the claimant having to attend for a medical assessment, which appears to have happened in your case. The decision on your fitness for work can be decided if there is enough evidence to consider that you satisfy the test by a process known as medical scrutiny. Medical Services will inform the ESA decision decision maker accordingly.
There is unfortunately no way of telling what will happen when you case next comes up for review in 2013? You may be called for a medical assessment or be considered to satisfy the WCA again by medical scrutiny, without the need for a medical assessment.
