Hi tilly
Congratulations -but what an ordeal for you. Hope it's confirmed sooner rather than later & you start receiving some money.
Best wishes

Hi All

After you have won an Appeal, do you still have to do another ESA50 form for Atos, as I was sent one last week. The man on the Helpline was not sure.

I called helpline this morning to find I had won my appeal and noone had bothered to notify me... but I was not getting any money as they seem to have lost my original sick notes going back to April..... I told him I have recorded delivery receipt of sending them to them. Alas, I still need to get new copies from GP.

I did my appeal forms before joining here, wish I had joined here first anyway. I thinK I won anyway, as by doing a 3 page summary attached to my appeal forms instead of trying to squeeze in the relevant sections for conditions, medication, procedures, which I did attempt on my previous forms. I did one long list of conditions as the heading, with symptoms of these conditions under each heading (tried to keep to short bullet point format) and anotehr of condtions as headings again, with medications and procedures (with dates and hospitals) under each heading. I am under a lot of specialists and do have quite a number of conditions, meds, procedures(ops) recently - so it ran to 3 pages. Hope that may help someone anyway - as trying to squash into boxes would have made me miss things out.

Yes, you will have to complete another ESA50.

It appears to be the case that when an appellant wins their appeal, the policy of Atos is to immediately send out another ESA50 and start the WCA all over again.

The word 'vindictive' also immediately springs to mind!

Appeal reason

The appeals team called my home number (I did not ask for them to call me and even though I have never supplied that to DWP....) after my queries this morning and I asked why I could not have copies of any documentation from the last Atos medical that I had over 6 months ago and they said that the reason the Appeal team found in my favour was that there was nothing supplied to defend against my appeal, as documentation was missing - do Atos have to provide a defence to your appeal and they had not bothered? I was really baffled as to why documentation to defend against my Appeal would not have been there? They also could not send me copies of the Atos medical either.....

Lost sick notes
The Appeal section said that my sick notes had beeen recorded and sent onto the ESA Benefits departments, but when I called the ESA section again, they said they have lost them and I have to send again.....!!!!!!

ESA50 and more medical
I called the ESA section again to double check that the ESA50 has to be done again and they said yes and that I have to have another medical yet again. They could not confirm how often I would have to keep going for them.

I hope they don't lose my ESA50 again, they did last time and would not accept a copy of it (despite the fact I sent recorded delivery and had a photocopy of what was sent), they made me redo it again.....

What a shambles... no private company could keeop losing things like this.

Thanks for all your support and replies.... I feel like I am wading in mud and with no vision of how to get out!

Hi Tilly
I am so sorry to hear about the appalling way in which you have been & are being treated by DWP & ATOS. I dread to think what it will be like when the 'efficiency savings' are made in the DWP. Hang on in there - we're all rooting for you.
Best wishes.
