Hi everyone:

Will simplify:

Where can I find out rules and regs concerning "Claimants need to score fifteen points to be placed in this group unless they are exempt or covered by the exceptional circumstances rules." Exemptions and exceptional circumstances?

For eg: I have angina, but refuse angiogram on the grounds that I am just too ill to tolerate radioactive contrast dye. The last time I had it, I suffered horrific adverse reactions. I simply can't metabolize meds and chems.

An angiogram would not necessarily "prove" angina anyway, because it only shows part of the heart, and in anycase, it could be microvascular.

I have several health problems which can't be proved or disproved because of limitations of tests and investigations.

I looked as if I am near death's door and am very weak.

The other question is: Can I ask/give to my doctors (and the DWP) a written Affidavit or a Statement, that should they deem I am fit to work, and should I worsen if I work, they would be held responsible?

I am terrified of taking tests and investigations in case it leads to worsening. For instance, I would NEVER take a treadmill test I have angina often during the day and night, and certainly if I attempt to do more than about three steps/stairs. It would madness to go on a treadmill...

As I wrote many times before, doctors are minimizing symptoms with everyone, and concealing blood test results which was done to me. I had a BNP for my heart failure. It was reported as "normal" I got a copy and it was well over 300, the ref range is 100 in other countries, then in the UK, they put it up to 120 and more recently to 127 <<wink>> <<wink>> effectively, if you are living in other countries, and you have over 120 BNP and other signs of heart failure even if the echo is normal (echos changes all the time, heart is dynamic) ... you will will have your heart failure diagnosis - but not in the UK, lol

In any case, I have all the symptoms and it is confirmed by echo. But even then, I don't trust what the cardio will say for my next echo. Cardiologists are now telling heart failure patients not to worry, it is nothing, and so forth. It is nothing "serious."

Hi I have just been reading your problem
i think you will find that you cannot
bring legal proceedings against the DWP.
There may well be a way by other means you
may be best advised to seek advice from a
legal advisor at citizens advice which will
not involve paying a fee.As for the 15 points you require your conditions sound
as they meet the requirements. Your med
records held by your gp which to see will
cost a fee i think its £10 you may discover
written proof from the tests and results
of your consultant. If that is the case you
can ask for copies again it may cost a small fee.I must also point out your Gp
can if he or She thinks it would not be
in your best intrest refuse you to look
at them on this there is nothing you can
do. I would Apeal the 1st
desion you must do this quick.Remember allways use the website it does work. Best wishes and good luck Mike

from what you say if you have heart failuer, then a normal x ray would be able to show this because high blood pressure, means that your heart has to work harder to push blood round your body. To cope with this extra effort, your heart becomes thicker and stiffer, which makes it less able to do its job
the thickness would show

Hi Chafur,

Details of the exemptions and exceptional circumstances rules are in our guides to the personal capability assessment in the members area.

The DWP don't ever do anything like angiograms or treadmill tests at a personal capability assessment.

Hi Dave:

My report shows:

Left ventricular dysfunction
systolic and diastolic dysfunction
Hypokinesia of the left atrium wall
Mild regurgitation
Mitral Valve Prolapse

Two heart attacks.

All this was caused by adverse drug reactions to a fluoroquinolone antibiotic and Mefloquine.


What I was pointing out, is that I requested a test for BNP which is a more accurate measurement of heart failure, than the ejection fraction.

My result was 400. The Consultant wrote it was normal. It certainly was not!! I find it sinister and unacceptable. My GP was horrified and referred me to another cardiologist, I told him I would contact the media. He told me not to.

It is such a struggle battling with DWP, Social Services and doctors, it feels as if I am working a 90 hour week :huh: feeling ground to a pulp ..
