When I applied for the Higher Rate for Mobility prior to the DWP not using correct legislation by stating anyone over 65 will be excluded from obtaining the Higher Rate from the Middle Rate even if they have enough points to qualify. I applied prior to the DWP amending their decision to comply with Government legislation in regards to all over the age of 65 beig denied the Higher Rate.This latest amendment by the DWP only changed in the last few years. But only for new applicants for P-I-P and not for existing Claimants like myself and anyone else over 65 prior to the amendment by the DWP on Government decisions. Could you please advise / provide me with the correct legislation for those over 65 and prior to the DWPs decision from the Government to allow over 65 year olds to obtain the Higher Rate for Mobility which the DWP denied me even though I had enough points which enabled me to claim the Higher Rate. Even though the amendment had not been instigated until after I reached 65 disallowing all Claiments 65 from obtaining the Higher Rate for Mobility. I am not aware of claimants over state pension age being able to change their mobility component of PIP to a higher award, Daily living component yes, not an issue.
We would advise you to seek help from your local Welfare Rights Specialist; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies in your area advicelocal.uk or you may want to try and contact a law centre in your area www.lawcentres.org.uk
