FIRST ESA - UC STATEMENT....... everything is wrong! was created by Jasmine3234
Hi I really hope someone can help.
Hi I'm so confused. I got my first statement for ESA - UC for £823.41. I messaged them saying I get Industrial Injuries Benefit (WHICH THEY KNEW ABOUT AND SAID SO IN MY JOURNAL) and although the amount looks about right, there was nothing in deductions on the statement.
Then I get another message today and a letter saying I'm being paid too much and my payment has been corrected to £530!
"The statement was corrected on 22 July 2025
What you're entitled to
Standard allowance
£400.14
You get a standard amount each month. You said you're single
Limited capability for work and work-related activity
£423.27
You said your health affects you at work or prevents you from working
Transitional protection
£0.00
Your Universal Credit entitlement is not less than your previous benefits, so we have not added an extra payment.
Total entitlement before deductions
£823.41
What we take off (deductions)
Other benefits
We take money off your payment
As this is an average of other benefits that you're continuing to claim
Industrial Injuries Disablement Benefitminus‑ £292.89
Money, savings and investments
minus‑ £0.00
We have taken £0.00 off your Universal Credit payment because you have money, savings and investments of
Total deductions
minus‑ £292.89
our total payment for this month is
£530.52
MY LAST ESA AWARD APRIL 2025
Living exp £92.05
Extra due to severely disabled £82.90
Extra due to disability Income Guarantee £21.20
Limited capability for work £48.50
= Total income related amount £244.65
Income and Benefits INDUSTRIAL INJURIES = £67.59
SO INCOME-RELATED ENTITLEMENT IS £177.06
I was getting £354.12 two weekly, so surely £530 for a monthly UC payment is wrong? I really hope someone can help.
Thanks

Hi Jasmine,
Sorry to hear you have found the process of managed migration has not gone as smoothly as you anticipated.
I'm afraid that we cannot check individual award calculations on this forum and so my best advice to you would be to contact Citizens Advice Help to Claim (HTC) when they open tomorrow with exactly the information you put in your post. They can offer support up to the receipt of the first correct payment so if there is an error in the calculation then they can advise you how to approach this.
This is the information from our ESA to UC managed migration guide about the HTC service:
"Citizens Advice Help to Claim This is the main source of help with UC migration. It is a national telephone helpline and webchat service, funded by the DWP but delivered independently and impartially by Citizens Advice to provide advice on eligibility for UC and support with making a claim. That support can continue up to the date of your first correct payment of UC. This means if there is a problem with your first payment, they can support you with challenging decisions or making complaints. Telephone: 0800 144 8 444 Webchat: www.citizensadvice.org.uk/about-us/conta...ct-us/help-to-claim/ Both services are open Monday-Friday, 8am – 6pm."
Best wishes

If you received a migration letter then surely your transitional protection payment shouldn't be £0? It looks to me as if that might be where the discrepancy is.

HI Jasmine,
One of the other mods has said I am actually allowed to calculate this if you've given me enough information, which I feel like you have assuming IR-ESA was the only legacy benefit you were receiving.
Note: this does not open the floodgates to me calculating everyone else's UC, thanks!!
The DWP should have worked out your total legacy amount.
From what you have said this is your ESA of:
personal allowance £92.05
support component £48.50
enhanced disability premium £21.20
severe disability premium £82.90
Total max ESA = £244.65 pw
Minus IIDB of £67.59 per week leaves
ESA of £177.06 pw
Convert to monthly ( x 52/ 12 ) = £767.26
This is compared to your indicative UC, which is:
standard allowance £400.14
LCWRA £423.27
Total max UC = £823.41
Minus IIDB converted to monthly = £292.89
Leaves indicative UC of £530.52 per month.
This is £236.74 per month less than your total legacy amount so in my mind, you should have received a transitional element of £236.74 per month within your UC award. That should appear as an element in the above list before the deduction for the IIDB. You initially would have seemed better off on UC because of the missing IIDB deduction.
Page 36 of the ESA to UC managed migration guide for members www.benefitsandwork.co.uk/?dlp=688118a18bc0c explains how to challenge the calculation of your award via a mandatory reconsideration. You have one month in which to do this (or up to 13 months if you have good reason for being late). If you have an online claim, do this via your journal. If you have a telephone claim you will need to call them.
We obviously cannot provide casework support on this forum so my previous suggestion to contact Help to Claim for ongoing assistance until your payment is right still stands.
Hope that helps

Angel, thank you so much!
I have put a message in my journal saying the same sort of thing, but no one has answered yet.
The other thing that worries me is that by time they looked at my message about receiving IIB and why wasn't it showing on my statement as a deduction, they had put the payment of £823.41 through. So I then get a letter saying I owe them the difference between that and £530.00 which would be my August payment.
Is it worth ringing them or should I hold for a couple more days to see what they say.
Again, thank you so much for your help.

HI Jasmine,
Great to hear you have sent them a journal message. I would be inclined to give them a couple of days to respond but if you're worried so of course chase it by phone.
Strictly speaking, the DWP overpayment recovery guide indicates that if you owe the DWP money (which I think you do because of the missing IIDB in the first assessment period) they can deduct it from anything they owe you. So when they sort the TE issue and you're owed some money it should all be sorted out. See 5.45 onwards www.gov.uk/government/publications/benef...very-guide#chapter-5
The reality though is that often they don't do this so you might find what's due to you being paid in full and then the UC overpayment being taken as deductions from your ongoing award at a maximum total deduction of 15% of your standard allowance (£60.02 pm).
Best wishes
