UC LCWRA and TP resulted in loss of CTR

Hello,
I have migrated from irESA, support group to UC. Now have LCWRA and Transitional Protection to make sure I am not financially worse off, but my council have reduced my Council Tax Relief by 50% and are billing me £95 per month. Some English councils, such as Dorset, realise this is unfair and LCWRA should be treated the same as ESA support group payments but not East Devon. I am therefore required to pay more council tax than a non disabled UC claimant who is able to seek work. This extra UC money pays for all my extra care such as support wardens and telecare in my sheltered housing, professional carer fees, non NHS treatments, aids and equipment etc. I read that the Scottish Parliament revised their law to class LCWRA as equivalent to ESA support group income for CTR assessment, as it they deemed it unfair and not the intention of the original law to treat them differently. Surely the government assurance that we will not be financially worse off migrating to UC should apply to all claimants, not a post code?

Hi TerriD

Thank you for your well formulated post. This is a subject I have raised on Rightsnet over the last year. It is part of the attack on disability Benefits which was started in the Media by the last Tory government and is being furthered by some Councils who believe that there should be cuts to assistance for disabled people in general. They prefer to do this insidiously as you have gathered by quietly changing thresholds, disregards etc.
That this was the preferred method of the Tories is illustrated by the fact that average Council Tax bills have risen 17% above inflation over the last 10 years whilst at the same time they boasted of cuts to Income tax on wages.
A Council that has been brought to my attention is Tandridge Council whic is cutting the savings threshold from £16000 to £10000. It was £16000 in 2006 and should now be £33000 if increased with inflation like our Council Tax.

My council seems to operate the scheme in exactly the same way as yours does. Switching from income-related ESA to UC has led to my council tax support going from 100% of the bill to 40% of the bill, meaning I now have to pay 60% of the annual council tax charge (£52 per month instead of £0).

Hi

Yet another Council using UC Migration as a smoke screen for massive cuts to disabled claimants. This time it is Somerset where Council Tax is administered by the notorious Capita.
The following is from Somerset Council CTRS document--
A disabled single person who receives UC (LCWRA group) and PIP (standard rate daily living)
receives the following income:
Weekly UC entitlement: £186.84
Weekly PIP entitlement: £72.65
Total weekly income: £259.49
Under the current scheme, PIP would be ignored, and a further £30 disregard would be
implemented so the income taken into account would be £156.84. This would mean a 75%
discount under the current scheme.
If all the proposals in this consultation were implemented (PIP no longer disregarded, no
£30 disregard and income bands changed)the income taken into account for CTR would be
£259.49 which would mean no entitlement to CTR. This resident would end up paying
around £100 per month extra council tax under these proposals---
