How Do Transition Protected Legacy Benefits Erode?

Hi,

Am currently in sheltered housing but am being moved out due to suffering bullying. I have recently migrated to UC from IR ESA Support Group and am still waiting for verification and statement. As I’m currently in sheltered housing UC don’t pay housing benefit so I get it paid by the local authority. My landlord has offered me a disability bungalow as an option but as it’s not actual supported living my rent will be paid by UC. As my UC claim was made while I’m in sheltered housing so no rent paid through UC will a subsequent claim for non-supported housing benefit through UC be viewed as a benefit increase and swallow up my legacy benefits? Hope someone can help with this. Thanks in advance😀

Hi Jul

It would have done before the following judgement in the Upper Tribunal last year which the DWP have accepted.
You will need to check that it is not being ignored by an inefficient Work Coach.
