Hi gazzmg

Who created the Trust? Who are the trustees?

A vulnerable persons trust is usually set up to safeguard the vulnerable person so they have someone looking out for their best interests, also it allows the vulnerable person to apply for means tested benefits still whereas having that money themselves would disqualify them.
Trusts are meant to be used to pay/help that person directly so yes, housing, direct debits for bills would be included to be used out of the trust. This has to be set up by the trustees who have legal authority over the trust. It's best that the trust pays the bills directly and not to you because this could be seen as income when it comes to benefits.

Hi Em and gazzmg

This situation is anything but straightforward. You need to look at the UC regs below---

What is included in unearned income?
66.—(1) A person's unearned income is any of their income, including income the person is treated as having by virtue of regulation 74 (notional unearned income), falling within the following descriptions—

(j)income from a trust, unless disregarded under regulation 75 (compensation for personal injury) or 76 (special schemes for compensation);

I would REALLY look into this. My friend has the Local Council as her Trustees, my mother has my sister. It has to be someone who will not abuse in any way; but quite frankly, that could be anyone…

I know of someone who is getting a Trust to exempt a Personal Injuries Payment from their benefits. To me it’s just a massive red flag to issues further down the road.

Get a lot of advice would be my advice…
