Hi all,

So following on from my 'Strange Phone Call' post.......

Had my PIP telephone assessment on 13th Feb and thought it went well. Received my assessment report 26th Feb where I was scored 10 for mobility (happy with that) but unfortunately only 6 on Daily living. Received text this morning saying I had been awarded PIP and letter in the post. Rang PIP and they confirmed that was my award.

Similar to Bud the assessors report in terms of what she has written was quite accurate but I just didn't score the points needed. I was hoping for Enhanced Daily living but would have settled for Standard. I am now putting together my MR so it is ready to send off as soon as I have received the Decision letter.

I am hopeful for the MR because on 5 of the questions the HP actually commented in the 'Other descriptor supported' box at the bottom of the page that she considered awarding me a higher score but for whatever reason she didn't. These were Q2, Q5, Q6, Q9 and Q10. So I am going to concentrate on these in the MR and hopefully hit a home run on one of them to bump me up to an award. So frustrating to come so close though.

I do have 2 questions though.

Q1 When writing to DWP for an MR do I have to use the official form or can I just write a letter stating everything clearly?

Q2. Does anybody know of the court case where a Judge ruled that just because somebody can communicate and engage with a Health Professional, that this should not mean they should be assumed to be able to engage socially with other people. Because a professional is not as intimidating etc. (I may have worded this wrong). I'm sure a Judge ruled on this a while back but I can't find the details anywhere.

Many thanks for your help.

Dan.

Hi dan123

You can apply for a MR by letter, you just need to mark it clearly that you are applying for a mandatory reconsideration.

If you use the CRMR1 form, you can add extra pages stating everything clearly, make sure you number them.

I am not aware of the court case.

I had the same with my work capability assessment, the decision makers decided that because i speak to my Mum & Daughter i able to engage socially, but i had to state that they are my support network and i don't socialise. I was so very frustrating.

Oh no! Sorry to hear that Dan, they know exactly what they’re doing.

I always got standard DL, when looking back I should’ve got enhanced. WR did my forms, & I was grateful & glad to be getting something. Until I got no points, not even 2 for bladder cancer. I did an MR & got my DL back but I realised that they always gave me 8 or 10 points, so I decided to go for those 2 extra points at the tribunal. I was only on the phone long enough for them to tell me that I was getting the extra points.

Keep on fighting, never, ever, give up!

Hi Louise,

It's ridiculous. Soon they'll be saying if you can ask for advice on forums such as these then you don't have any problems communicating!!! I often think if there is place for AI it would be to conduct these assessments.

Hi Bud,

Indeed they do know exactly what they're doing! I won't give up though. Going to see this through to the end whatever the result.

Good luck with your MR.
