Have read my last two posts and neither refer to my last posting on Friday 3rd December.
 
Longish story but here goes.....received MR letter last week concerning back payment after Leap Review using template letter supplied by B&W. DM used two irrelevant High Court judgements pertaining to Mobility issues when my request was written under Daily Living 'Engaging with other people face to face'. After an 82 minute wait on phone I couldn't really get a sensible answer as to how the decision was made or whether there would be a possible award for the MM v DWP judgement. I was vaguely advised to ring back in couple months. So by that time it would be too late to appeal.
 
So today I checked the paperwork again and was appalled to discover that the copy sent to me last week (along with MR letter) of my original 2017 award had one descriptor omitted (or removed) which then totalled only 8 points instead of 10. So the DM couldn't award any back pay because my points were too low. A silly mistake or something a little more devious? We're talking around 6K in back payments.
 
Just wondering how many more flaming hoops I'll have to jump through.
 
So do I now take it to appeal?

  			 				So today I have received MRN for back payment under Leap Review (engaging with people face to face) This was after two separate surprise telephone calls from the Leap team last week. No back payment, original decision upheld. As the decision was based on my initial assessment in June 2017 I knew I wouldn't succeed. I later proved the HCP had 'lied by omission' but 5 years later the Dwp still chose to believe the Atos information.
 
I am taking my case to Appeal.
