DWP reconsidered their decision midway thru appeal

Hi, forum.

We were appealing middle rate on both components decision. As mandatory reconsideration didn't change theverdict, we appealed to the tribunal. All of a sudden we got a letter from DWP, saying that they reconsidered their decision and awarded me with enhanced rate for both components "based on new evidence".

The thing is, we haven't provided any new evidence, neither could we. I have severe ME (Chronic Fatigue Syndrome). There's no treatment or even tests for this condition. No specialists are involved. So, no medical evidence exists, especially after about 10 year, during which you're left to fare on your own. The only conclusion here is they hope that you won't appeal. I can't explain it any other way, because there's no difference between what was in original claim or denied Mandatory Appeal and what was sent for Tribunal Appeal. I'd say, it's about who blinks first. It's a bitter-sweet news, and I feel sad for those severely disabled, who don't have a carer to help them to fight all the way.

My thanks to all the information and detailed advice that Benefits and Work have provided. You have been a great help.

A very well done, whilst it does happen it is still unusual for the DWP to revise the award before the Tribunal hearing, congratulations.
