Well another huge thank you to the people at Benefits and Work. It has taken a lot of work to get to this point but I was today awarded the higher award level for both daily living and mobility. My previous award given from May 2015 to Apr 2018 was reviewed a full year early and I lost points. Apparently, the judge told me that the Upper Tribunal has ruled this early review was wrong and my higher rate for mobility was re-instated just like that. I admitted my asking for higher level for the daily living was tenuous but they gave me that as well. Very pleased indeed! Thanks again.

Can I ask, what are the dates on the award?

We have seen the Judges comments before, the issue has been that the reinstated the original award without extending it, as a result and due to the time for a hearing to be convened, the existing award has or is about to expire and the claimant is left having to re-apply for PIP from scratch.

I am hoping that this has not happened in your case.

Hi Gordon. Thanks for your question. I double checked and they have back dated the re-instated award to the original decision date of Sep 17 until Jul 23 and they have also given the new enhanced award for the same period. Hopefully they will leave me alone now for at least 4 years. I admit I had been concerned that it would only last for another few months and then I'd have to start all over again. However...I note it states in the tribunal letter that it cannot enforce the DWP to enact on their decision which is both surprising and a bit deflating. Has the DWP ever refused to abide by what a tribunal finds?
