I apologise in advance if I have posted this query in the wrong place, i have never posted anything any where before so am unsure if i am doing this right or not.
I received a letter yesterday with the decision from my PIP, I was already in receipt of DLA Medium care and higher rate mobility, although my DLA was not due to run out until 2016 I was told I would have to reapply for the PIP as I had changes to be made. My health was getting worse and on top of already having arthritis of the spine, (my spine is crumbling and my surgeon had said there was no more he could do for me as he didn't want to chance making everything worse ) Firomyalgia, meniers disease, panic attacks to say but a few I have recently found out that I have a heart problem.To top it all off my husband just left me leaving debt and wanting to sell the house off, so have no idea where im going to live.
I thought things couldn't get any worse when I received the letter. Ive been told they are taking away the mobility part of my claim and I have to return my blue badge and my mobility car.
I'm already house bound and have no social life or friends I cant walk very far due to my condition(I have to use a stick) my parents and daughters live in the same village so having the car meant I could get out of the house every so often and take my self to the local doctors without having to rely on any body else, I cant drive long distance due to cramping pain in my back and legs so any hospital visits ect. my dad usually took me.
I feel like my whole world is crumbling around me I am already on anti depressants and receiving counselling because of recent events I just don't Know where to go from here,
I'm sorry if I'm babbling but I am lost knowing what to do.

I am sorry to hear of your problems.

I'm afraid that a PIP Mobility award is one of the areas that the Government have made particularly difficult to get.

You only mention the Mobility component, did you receive a Daily Living award or were you not expecting to?

If you have no award then you can make a new claim for PIP immediately, new claims are being processed quite quickly now.

As an alternative or in addition, you can challenge the Decision that has just been, if you do both then you need to be aware that a new claim will supersede any award made by an appeal.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process and template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
