I helped a friend with their claim for ESA.

He requested the WCA be recorded this was 2 months before appointment. They also asked for home visit, refused.

They told the person on the phone (Maximus) that he had problems getting out. The person on the other end told them, that they had previously had no problems getting to the centre before. I ask my friend could I speak to the person on other end off phone, they consented.

I told the Maximus Man, what happened before has no relevance, this was a completely new ESA50 claim. No appointments for home visit.

They turned up for WCA, I went with him for support. He asked was the WCA being recorded told yes signed paperwork.

The were called in, I sat outside, after 20 mins they came back out with the HP, my friend looked stressed and depressed.

He told me the first machine did not work, second one dos not work.

The thing that my friend told me shocked me. The HP had done his previous WCA recognised my friend, gave him 0 points last time for everything.

In the room my friend said, he told them "that they could carry on with the WCA without it be recorded, as was not the same as the last time and the result would be different".

My friend said no, I want it recorded. Meeting stopped.

My friend asked me to come to reception desk with him, he asked the HP tell me what he said in meeting as he was confused. The HP repeated exactly what my friend had said.

I told the HP that this was out off order, as completely new ESA50.

My friend also asked why the equipment had not been checked beforehand ? they had enough time, two machines failed.

Advice on complaint to put in.

Hi WmW,

With regards to your friend having to attend the Assessment Centre, I agree that it should be the limitations that they were suffering at the time of this current reassessment that should have been taken into account, rather than how they may have been at a past assessment.

However, Maximus, as with ATOS before them nearly always insist that the claimant must provided written support from their G.P. for a Home Assessment.

With respect to Maximus not having the facility to record the assessment as promised, they do state that they will provide recording facilities where requested, and you could pose the arguments stated in our template letter : "Letter asking for your medical to be recorded" on : This Page.

Even though the letter cites ATOS the same would apply for Maximus.

You could also involve your friend's M.P. : Contacting your MP

You could bring up all the issues mentioned in your post in a complaint to Maximus :

Contact Maximus (CHDA) Complaints, etc.

Your friend does need to contact them anyway, to see whether they have returned their file to The DWP, or they are to re-arrange for another assessment.

Hi, Bro58' thank you for that reply, I will do as you advise. My friend wants to put an complaint in, so will get on with that.

The other thing that comes to mind, can he ask for another HP,
,whilst complaint is active. They have booked my friend in again end of September 2015?
