ESA appeals adjourned re reg 35 Tribunal Decision

My husband was moved into the WRAG group from the Support group following a medical. Mandatory reconsideration agreed with decision so we appealed. He receives no ESA payments when in WRAG as 365 days exhausted and I am in full time work. Went to tribunal Dec 14 to be advised by judges they were going to adjourn awaiting the outcome of the Upper Tribunal Decision about the evidence DWP need to provide about what requirements are in WRAG group, reg 35. We have now received another tribunal date for September 15 but I am unable to locate any information about what the outcome was. Would anyone be able to help?

We have heard of this with other members !!

However, it should not cause any further delays regarding your hearing in September !!

The Secretary of State did not appeal the 3 Judge Panel ruling.

If you read from This Post onwards in the topic, you will see that the member in question was eventually successful in being placed into The SG under ESA Reg 35.
