Hi,
I was told by ATOS I was fit for work at my assessment in Dec 2014? Even though my Doctors and Physio have diagnosed me with STENOSIS. Which means I have difficulty in walking more than 10yds.
I was advised to register with JSA+ as I am unable to work. Which I did.
I appealed against my decision and sent my completed forms off too Tribunal Services in Dec 14.
I heard nothing so my advisor at the JSA told me too phone and check what was happening?
I did this and a lady informed me they had not received anything from me??
The advisor at JSA downloaded another form which I completed and sent in a registered envelope.
I have this morning received a letter from ESA saying I am to receive £73.10 per week?
I was receiving £105.20 per week on JSA???
Can anybody help???

My full name is showing, how can I stop it?
If you have appealed the adverse ESA Decision then you are eligible to receive the ESA Assessment rate rather than JSA, however, the DWP should have asked you before putting you back on ESA.
Do you receive DLA or PIP?
If you do then while on JSA you would have been entitled to the Disability Premium, this Premium is not payable with ESA and would explain the discrepancy.
If you do not receive DLA or PIP then you will need to contact the DWP about the difference.
If you have not already done so you should have a look at our ESA Appeal guide for more information about the process.

Sorry if this has already been mentioned before, but this is sort of related as it is based on what you say about the Disability Premium not being payable to those on ESA...
Am I right in thinking, therefore, based on what we currently know at the moment about future plans to remove the WRAG amount payable to new claimants in the future, that those found to not be entitled to the Support Group - but in receipt of DLA or PIP - may find themselves worse off on ESA than JSA due to the lack of this premium?
This sounds very, very, very unfair if so, bordering on perverse in fact. Yet, somehow, I wouldn't at all be surprised.
