Severe Disability Premium was created by ka
My partner lives with his mother and has been refused SDP on the grounds that she is in work and is not receiving benefits. Is this correct? He is in receipt of Enhanced Rate Personal Independence Payment and is on Income Related ESA.
I have suggested that instead she claim Carers Allowance for him instead. Do you think this is the best route to take given DWP have rejected his IS10 and claim for SDP. He is very disappointed that he does not qualify for SDP.

Ignoring the other requirements, you can only receive the Severe Disability Premium if you live alone, the exception to this if you do live with someone else, is that they must also be in receipt of suitable DLA/PIP/AA award themselves. If their mother is not receiving any benefits, their working is not relevant, then they are not classed as an exception and your partner is therefore not living alone.
The mother can only claim Carers Allowance if she is able to provide a minimum of 35 hours a week of care and she cannot earn more than £110 per week after deductions. Obviously the money would be hers and not your partners.

I'm guessing that I, as a recipient of the SDP, could not receive Carers Allowance for my partner either?

Hi ka,
Although it would not be possible to receive full CA for providing 35 Hours/Week of care for your partner, if you receive The SDP, you may also be entitled to The Carer Premium (CP) rather than full CA for providing said care.
