Hi All
14 months after filling out PIP application, my son finally had his assessment at home. The assessor was dreadful ( another story). Requested her report the day after she left. Anyway received report and DWP decision letter, later dated 6/5/15. I phoned on 18/5 requesting a mandatory reconsideration for him, told the person on phone that I would be following this up with a letter and a detailed account of points we wanted reconsidered.
Posted the letter, will recieve it today, sent it recorded.
Anyway, my son has received latter today, saying they have reconsidered his award and it's unchanged. They say the next step is to appeal.
Are they able to do this if they know extra info is being sent? Is it worth phoning them on Monday and asking them to look at it again with further evidence? Or should I apply to appeal straight away?
They used the assessors report and our initial application again. As we applied so long ago, my sons health has deteriorated significantly since then. We did tell her this on day of assessment.

It is one of the problems of making an MR request over the phone, the full details of the conversation may not have been recorded correctly and this often results in a Decision being made before the claimant has had a chance to submit further information.

You can try and get a new MR, it will likely be at the discretion of the DWP. Unless you have evidence that fundamentally changes the information that they currently have then you may struggle to change their minds. Turnover rates are low under normal circumstances and a second refusal would reduce your chances further.

Alternatively, aAs you should now have a MR Notice, you can go straight to appeal. Have a look at our PIP Appeal guide which has links to the form you will need to complete and details of how to complete it.

Whilst appeal times have reduced considerably this year, getting a turnover with an MR will obviously be a lot quicker than having to go to appeal.
