pip court appeal question & dwp paper work

:blink: hi,can anyone tell me about a few things?
1-on my pip consultation report form ,the NURSE.....says she has considered evidence from my gps /psychiatrist letter dated for such a date but makes no reference to a 2nd letter by the gp in more detail,the first was no more than 2 setences!
2-also the NURSE has said she took evidence from my medical report which has no questions whats so ever to do with pip,as i live abroad i was given a e213 medical
3-i have seen other littel things would it be wise to mention these to the hm court appeal or should i focus only on the reasons/ questions i am appealing for?
any help is appreciated :cheer:

You may need to spend time showing that the information in the assessors report is incorrect or does not apply to you but you will only receive an award if you can show that you meet the criteria for one, so this must be your priority.

1. Unless you can show that the points you raise specifically affected the Decision that was made, then there is little point in raising them as issues with the Tribunal, all you would be doing is diluting the effectiveness of your submission.

2. Even though the E213 report is not specific to PIP from previous posts in this subject it is used to assess claimants living abroad, you need to tackle this medical report in the same way as one done in the UK, show where it is in error.

hi gordon,does eating crisps chocolate sweets count as nutrition?or is it classed as proper food?
also can you tell me how to change my forum name

I assume that you are referring to the Eating and Drinking question. The legal definition for Take Nutrition is

(a) cut food into pieces, convey food and drink to one’s mouth and chew and swallow food and drink; or
(b) take nutrition by using a therapeutic source.

You may be able to argue that the phrase "cut food into pieces" excludes the items that you mention, see our PIP Claim guide for more information.
