DLA Supersession. was created by francis1969
Further to an earlier post dealing with change of circumstances, and after reading 'How do I report a change of circumstances if my condition
has deteriorated', in your DLA changes and renewals, do I take it is possible to request my current award to be looked again, by way of letter? Rather than completing a full further DLA app.

Obviously, to be included in letter would be current award and details for such, detailed explanation of deterioration and how this involves night time needs, (as explained in post a month ago and some), even including photographs, consultants reports and additional information from my partner (carer) plus other helpful info.

Am I right in thinking that in this letter, I should also notify them of the fact that I do not wish them to look at my current award as there has been no change (regarding my HRM & MRC), and wish them only to look at my care needs throughout the night?

Attempting to think of every possible scenario to calm my brain!

There are several issues that you need to be aware of before proceeding.

If you are in an active PIP postcode then a reported Change of Circumstances will result in an invitation to claim PIP not a re-assessment of you DLA.

www.gov.uk/government/publications/pip-postcode-map-uk

You can ask the DWP to limit their review to just the changed component but they are not required to do this, also I think it unlikely that they will only look at your Care needs overnight in isolation from those during the day.

That does not mean that you should not progress the CofC, but at the very least you should check whether you would be invited to claim PIP or not.

HI Gordon, My above post was effectively a continuation from query about 1 month 2 days ago! Am not in PIP postcode and confirmed still under DLA rules and regs.

Main point of this query was requesting supersession by way of letter as oppose to completing lengthy form-this is my understanding from DLA guides, that you previously directed me to.

Again Bro58 and yourself, had already said (in earlier query) that 'Based on what you have posted you would seem to meet the criteria for night time care'. Again, I know it is only I that can make decision to go ahead in having current indefinite award of HRM & MRC looked again. Hope it is clear I am not taking this decision lightly.

Although main reason for having DLA looked at again, is with regard to my severe skin condition, there is also the additional (now more frequent) help/assistance required from my partner with my getting to/from and using the toilet (as they are in the day) and fact that my chemotherapy induced peripheral neuropathy, affecting my hands and feet, has over the years worsened. All factors mentioned are now lifelong symptoms.

I am merely setting out my stall for the next month or so, before biting the bullet as currently also under endocrine unit, late (chemotherapy) side effect clinic, and undergoing tests from NHL team (as I did over a decade ago!). Will await results of current investigations and let you what decision is arrived at in weeks to come.

TY again.

In fact, adding to content of my query a month ago, sat here discussing the points of care needs at night, my partner has quite rightly pointed out added reasons which would come under heading or either 'to prevent danger to myself' or at least 'I am at risk of harming myself'. The reasons for this are that for the majority of nights, I suffer what can only be described as 'scratching fits' or 'friction fits', most of which occur whilst I am asleep. These action inevitably wake my partner, who in turn has to wake me, as I am unaware of my actions/movements.

Scratching fits should be self explanatory, but my friction fits involve the strenuous rubbing of each of my hands/wrists/feet against the other. This results in either 'weeping' or bleeding, or both. Although specifically, my hands and feet are medicated/treated prior to going to bed, including the need to wear cotton gloves and socks, on the nights as described, as well as the intervention by my partner, this would also necessitate the changing of soiled gloves/socks and even to the extent of full change of night attire, re-application of steroid creams/ointments and moisturisers, together with the additional hassle of my partner having to bring a drink and antihistamines/sedative antihistamine.

The above, of course, is in addition to the times that I am awake and know what I am doing, although this does not lessen the help and assistance I need!

I am afraid that it is at the discretion of the DWP how they handle a Change of Circumstances, a detailed letter may provide sufficient information for them to make a Decision, however, even with this they may insist on you completing a re-assessment form and it is possible, although I think it unlikely, that they will require you to have a face to face assessment.
