I thought I should start a new thread even though there has recently been a post about a claimant being awarded PIP and then unexpectedly getting a request from DWP to fill in a new form.

Last August I was awarded PIP through to August 2017.

BUT the ATOS HCP in the medical report suggested a review in 2 years. AND the DWP letter awarding me PIP said I would be contacted after August 2016 to make sure I was receiving the right level of PIP.

So what does this mean? That I will have to renew the claim in 2016?

I queried this with DWP and they said in writing that I would be paid until 2017; I would not receive an invitation to claim again in 2016; and I would be invited to re-apply in 2017.

I am totally confused. Has anyone else awarded PIP in recent months got similarly confusing letters?

Why, in my case, mention 2016 if it is irrelevant? If indeed it is irrelevant.

I do not trust DWP. Should I assume I will be re-assessed in 2016 and ignore the replies the DWP gave in writing?

I will be interested to know what members and the panel make of this.

Our understanding of the situation at the moment is that claimants with an award of less than 10 years will be re-assessed one year before the award ends.

We have several members who are now going through this process, what we do not yet know is how the DWP will handle the results of those re-assessment, especially where it results in a Change of Circumstances. I am afraid that is wait and see!

Just to let you know I have been sent a form to fill again. One year before end date, I was awarded 3 years. I have also noticed that on the form that they don't want letters From family, friends,neighbours, or welfare rights advisers.

Thanks for the update, I am not aware of any legislation that allows the DWP to restrict the evidence that a claimant might choose to send, of course they are still at liberty to assign it little weight if they choose.

The problem with DWP is that I surmise that relatively junior staff are misinforming people in writing too! In my case they clearly stated to my yes/no request for an answer that I would not be contacted after 2 years.

I don't suppose it would cut much ice if I were to fling this letter back at them when I Get the reclaim form after two years.

Today I rang up to re-re-confirm and yes, I will receive a reclaim form after two years have elapsed.

But, what happens if re-assessment is completed before the original three years are up, and I was unsuccessful? Would I still be paid up to the original award end date?

Confusing in light of my original HCP's stated recommendation of two years' PIP award.

I know of claimants who have successful used a DWP letter to defer a re-assessment, however, not for PIP although that does not mean you could not. The biggest problem is that the PIP legislation allows the DWP to assess someone at any time and for any reason, there is not even the three month delay that ESA has and there is certainly not the one year that DLA uses.

A this time we do not know how the DWP will handle a Change of Circumstances discovered by a an early PIP re-assessment, the PIP legislation does not cover this, so until someone goes all the way through the process we will not know.
