Change in my condition was created by Jan
Hi my name is Jan over the last 2 years my condition had deteroirated do I request to change from DVLA and ask to be reviewed on PIP? It took me a year to appeal ESA went to appeal court and was straight way put into the support group but it was so stressful I couldnt relax I was a nightmare to live with.
I'm now in a wheelchair I've purchased a drive from wheelchair car as the criteria changed when I went to apply as I couldn't commit to 12 hours voluntary work or a course at college. Needless to say I took out a loan. I then couldn't get out of the house with my wheelchair as it wouldn't go through so we had new doors fitted with no lip. Then we've just had a wet room put in as I couldn't use the shower cubicle had the bath taken out as I got stuck in it when we moved to this bungalow. Why have we had to pay because my husband works!
I feel that my family have to make so many changes because of me we are now paying back all what we have loaned hence do I request to be accessed for PIP now or wait until that dreaded brown envelope drops through the door?

There are two aspects to this.

First you need to check whether you are in an active PIP postcode, if you are then any reported change of your conditions will result in an invitation to claim PIP. However if you are not then you will be re-assessed for DLA. See

www.gov.uk/government/publications/pip-postcode-map-uk

If you are in a PIP are then you need to understand whether you would score sufficient points for an award, have a look at our PIP Claim guide and I would recommend that you mark yourself harshly. See

www.benefitsandwork.co.uk/help-for-claimants/pip

If you are not in a PIP area the it will be DLA, again you need to understand whether you will qualify for a higher award, a higher DLA rate will not necessarily be the result of a claimants conditions getting worse.

If you receive;

Lower Rate Care then you will need to show that you now have substantial care needs during the day OR night.

Medium Rate Care is awarded because you have substantial care needs during the day OR the night, to receive the Higher Rate you need to have care needs day AND night, so a worsening of your condition during the day (as an example) will not result in a higher award.

Lower Rate Mobility is awarded because you have been found to have problems going out or in planning and following a route, Higher Rate Mobility is awarded to those who have problems walking.

I have decided to wait for the brown envelope. My friend today received her decision it was declined plus she has to pay her money back form February. Why do assessor's lie say things she didn't do or say and leave things out. I had enough going through ESA and appeals, so I'm going to wait and get my information ready.

Thanks for your help I now have your guide printed out.

It is very unusual to be asked to pay back benefit, even if it is decided that you do not qualify for the benefit in question.
