Hello, I had my PIP decision today - enhanced care but nothing on mobility. I think this is incorrect but I'm not sure whether to ask them to reconsider in case they take anything away from me. Also, if I ask for them to reconsider do they hold back PIP payments until the decision has been made? I was on DLA but that is due to stop by March.

I'm worried that this decision may also affect a claim for ESA which is what I intend to do next. I'm afraid that if they see I don't' get help with mobility then I will be fine with work-related tasks, which is not the case.

There is always a risk when challenging a Decision as those looking at your award can make any Decision that was available to the original DWP Decision Maker, that said, it does not happen often, but you should look at your Daily Living award to make sure that it is secure before proceeding.

Another factor to look at is whether you can score the extra points you need for a Mobility award, your Decision Notice should detail what points you scored if any. Points from both the Going Out and Moving Around Descriptors count towards a Mobility award, I would recommend that you mark yourself harshly. If you do not think you can bridge the gap, then you should think very carefully before challenging the current Decision.

Whilst there are similarities between the PIP Moving Around Descriptor and the ESA Mobility Descriptor there are also considerable differences, so as a general comment a failed PIP mobility test will count against you in regard to ESA, however, this presumes that the PIP assessment report is used in the first place and this is mostly certainly not the case, also we have also seen one awarded and not the other, so it can be down to the assessor on the day.

Thank you Gordon,

I am looking at the file entitled "Submission re: Planning and following journeys" and I believe that this is where things have been confused. I have been awarded 4 points for needing prompting to undertake a journey but I actually cannot undertake any journey without someone with me and someone to ensure they can deal with my panic attacks and to monitor my anxiety so they can get me out of situations that may trigger attacks. The person who is with me makes sure I avoid any situations that may cause extreme anxiety and speaks for me if people come up to avoid distress to myself. I also frequently need help in abandoning journeys mid-way because my anxiety becomes so bad I can't cope.

My assessment didn't focus a lot on my anxiety although I did have two assessments because during the first I had an anxiety attack as the assessor told the person who cares for me they couldn't help me explain myself so talked to me directly and I suffered a fainting fit as a result. During my second assessment the lady focused more on my other conditions which include M.E. and other mental health disorders and I don't feel the extent of my anxiety issues were fully understood.

I just want to make sure that your fully understand the implications in regard to this particular Descriptor! I want to stress that I am not trying to "push" you in any direction, just trying to make sure you are fully informed

As you can see from the document our view of the way these Descriptors should operate is at odds with current guidance issued by the DWP. We have had a significant number of members marked down to 4 points when they expect to score higher, to date I am not aware of anybody who has successfully convinced a Decision Maker that their view is flawed.

There have been a limited number of PIP appeals to date and the change in the guidance is still relatively new so we are currently unable to give a view of how PIP Tribunals are viewing this approach and ultimately it may require an appeal to the Upper Tier Tribunal before it is resolved.

So, I think it likely that any challenge in this area will require you to go to appeal if you are to have any chance of a revised Decision, you should factor this into your considerations.

Hi Gordon,

Thank you for explaining this to me further. Even though I feel I do struggle more I think I will leave the reconsideration as I don't think I would be able to physically and mentally be able to cope with an appeal. I am very happy with my daily living component decision and pursuing the mobility part wouldn't be about the additional money, I am more worried about any effect on ESA but you have put my mind at ease regarding this.

I have looked at the ESA guidance and what I have been awarded for PIP care transfers well to some of the criteria for ESA so I am less worried. I know the two may not affect each other but it is reassuring nonetheless. When I do start my claim for ESA I will make sure to post in my other topic.

Hi, I am in the same position - I received enhanced daily living but just 4 points on mobility. I also feel it's not about the money but it seems wrong that the DWP's guidance on the 'planning and following journeys' activity seems to be an attempt to subvert the legislation in order to exclude the majority of claimants with mental health issues from qualifying for the mobility component.

I'm aware of the risks of submitting a mandatory reconsideration, in that the whole award can be reassessed. I believe that the account I submitted on my PIP2 form was consistent with the medical evidence from my CPN and the medical assessor's report, so my enhanced daily living award should be fairly secure. However, this does not stop me from worrying that the decision could be changed maliciously just for daring to request a mandatory reconsideration of the mobility element..

Anyway I overcame the fear, at 5pm on the day of the deadline (13/02/15) and phoned up to request the reconsideration. I was shaking with fear. The man who took the request was very kind and pleasant and suggested I follow up the request with a letter explaining my case more fully - I'd put a letter outlining my reasons in the post just before I rang.

So now I have to endure several weeks of panic and self recrimination until I get the decision letter.

Even though I'm scared to bits on the one hand, on the other I feel like I'm standing up to a bully. The DWP are counting on terrifying us into not challenging their decisions. So although my knees are knocking I've made my stand...

I'll update you when I receive a response.
