good morning i am on dal and sea support group this morning my wife received a letter asking her to attend a interview to potentially look for work or courses she is my carer even though we don't get the allowance for this can they demand her attend the job centre

If your ESA is a joint claim, which it will be if you receive ESA(IR) in part or in whole then your partner is required to attend regular Work Focussed Interviews as a condition of your continuing to receive the ESA(IR).

The interviews are usually a formality with JC+ advisor asking if there is anything that they can do to help your partner into work or to increase their hours if they are working.

Your partner cannot be required to work or to seek work nor will they be required to participate in any form of Work Related Activity.

Although it is a joint claim you are the primary claimant, so they have no legal authority to put requirements on her beyond her attendance at the interview.

if they persist and state she has to do something is there legislation she can throww at them

There's no legislation she can quote because they cannot ask her to do anything other than attend the meeting.
