Application for a Blue Badge was created by FLORENCE McGOWAN
We applied for a renewal of a blue badge on behalf of our granddaughter who is now 16. On her recent DLA award she was given the lower rate of allowance, prior to this she had been on the higher rate. She had to attend for a mobility assessment and was subsequently refused the blue badge. We appealed on the grounds that had she been in receipt of PIP she would receive the blue badge. This appeal was denied. Although she has minor mobility problems. She is unable to plan a journey, as she has short term memory problems, she cannot read or write. She has numerous hospital appointments. We informed the local council of all of her health conditions and how many hospital appointments she has in the year. e.g. this month alone she has 4 appointments. As she will remain within the school environment until she is 18 she will remain on DLA and will not proceed to PIP until then. Can anyone offer advice on this subject.

Whilst your daughter was under the age of 16 she was assessed for DLA as a child, now that she has turned 16 she is considered an adult. The primary difference between the two is that as a child her abilities are compared to those of children of the same age, I suspect that her HRM award was a result of this.
As an adult the test for HRM is determined by her ability to walk, your post does not suggest that she any problems in this area or if she does that they are minor, this would seem to be confirmed by the award of LRC which is awarded for claimant who cannot go out or if they do would struggle to plan and follow a route.
The Blue Badge assessment, whilst less strict, is also based on her ability to walk, if you cannot show she has problems in this area then the LA would be right to refuse a badge.
I am afraid that I do not believe her claiming PIP would make any difference to this, as automatic entitlement to a badge through PIP is still based on the claimants ability to walk, she would need to score 8 points or more for the ‘Moving around’ activity. Points from the ‘Planning and following journeys’ activity are not be taken account.
