proposed changes in January was created by micksville
Hi,
Just received a twitter update from a site called welfare weekly. Theyre reporting that a "new list of evidence/information claimants can submit for esa and pip will be published by dwp in January.

Also, something about a tribunal ruling which is about to prompt a new approach for descriptor surrounding manual wheelchair users is imminent. Cant find anything on dwp sites, I wonder if members or moderators are aware of anything.

Hi mv,

"Just received a twitter update from a site called welfare weekly. Theyre reporting that a "new list of evidence/information claimants can submit for esa and pip will be published by dwp in January."

Yes, I have just become aware of this myself from this rightsnet news headline :

"DWP to make it clearer that evidence from care professionals can be valuable when assessing eligibility for ESA

New edition of Stakeholder Bulletin says that revised ESA50 form, which will list the types of evidence or information claimants could send, will be launched early in 2015"

On this page :

www.rightsnet.org.uk/

I have had a quick look for the December 2014 Stakeholder Bulletin, and it doesn't seem to be in the public domain yet.

It will probably be available over the coming days, and we will update here when we have access to it.

From the "Headline" it seems that the revised ESA50 will include examples of evidence that the claimant could provide with The ESA50 to aid their WCA.

There have been no recent changes to legislation, so the qualifying criteria will remain the same.

"Also, something about a tribunal ruling which is about to prompt a new approach for descriptor surrounding manual wheelchair users is imminent. Cant find anything on dwp sites, I wonder if members or moderators are aware of anything."

Yes, again this came to my attention just today.

3 Judge UT Ruling on Mobilising & DM Guidance (ACTIVITY 1 AND USE OF MANUAL WHEELCHAIR) :

[2014] UKUT 308 (AAC)

Associated DM Guidance Memo :

Memo DMG 37/14 ESA : ACTIVITY 1 AND USE OF MANUAL WHEELCHAIR. (Dec 2014.)

Thanks Bro...being the cynic I am, or rather IDS has made me, I initially thought there was a narrowing of the criteria in the offinghttp://www.manchestereveningnews.co.uk/sport/football/football-news/comment-man-city-fans-must-8258470surrounding evidence/info that claimants can submit. I will take a look at links but from what you say its to be guidznce to assist claimants by giving greater info for what they can submit. Thanks again

Call me cynical also...if DWP know the info they require to assist them to make the decision, why not just ask those best placed to provide it? ie. why don't DWP just go straight to the GP, HCP etc?

It also seems that the DWP guidance has been updated re: the recent adverse incontinence decision although the attachment to the DWP circular doesn't appear to open so no idea what it says
