Hi

I recently had a mand. Recon decision on my lower rate mobility award which was left unchanged.

I am wanting to introduce other arguments in my appeal which were not contained in the mand. Recon. request.. Specifically about planning routes 11c.

Would a tribunal disallow my appeal because I had not referred to this in my initial recon.request?

Hi A,

As The PIP First Tier Tribunal will re-look at the adverse decision with a totally "fresh pair of eyes", they will take into account all evidence that you or the DWP place before them.

Is this risky then? Fresh pair of eyes suggests tribunal could, in extremis,, reduce an award or reverse a DWP decision?
I was awarded higher rate daily and lower rate mob.
Should I stop and seriously re-think this?

Hi A,

Nothing has changed, there has always been a potential risk when appealing an adverse decision.

It is therefore important to risk assess your current award to consider how safe it is.

However, if a tribunal are considering making a decision on reducing or stopping a current award, they must first issue you with a warning, and give you the opportunity to withdraw your appeal
